User Agreement
This user agreement will be effective for all users as of September 15th, 2021.
1.0 PREFACE
This user agreement is a contract between you (the user) and Go2fete.com Ltd., a Grenadian company, governing your use of your Go2fete account and the Go2PAY Product services.
Go2PAY Product services are provided by Go2fete.com and allow you to create & maintain products for sale on your web site. We provide you with a URL to display/Embed on your web site or other online portal. If you are a registered Go2fete.com member you can access this service with your account but must meet the required criteria noted below.
You must be at least 18 years old to sell Go2Pay products & services. If you are a business, the business must be organized in, operating in, or a resident of one of the countries/regions listed on the Go2fete.com registration page when you registered to use the Go2fete.com web site & Go2PAY product services.
Please read carefully all of the terms and conditions of this user agreement, the terms of these policies and each of the other agreements that apply to you.
We may amend this user agreement and any of the policies listed from time to time.
The revised version will be effective at the time we post it on our website, unless otherwise noted. If our changes reduce your rights or increase your responsibilities, we will post a notice on the Policy updates page of our website and provide you with at least 14 days’ notice. All future changes set out in the Policy update page already published on the Legal Agreements page at the time you register for the Go2PAY services are incorporated by reference into this user agreement and will take effect as specified in the Policy Update.
If you do not agree to the revised terms and conditions, you must stop using the Go2Pay services and terminate your relationship with us without cost or penalty. This user agreement will continue to apply to your previous use of our services.
1.1 CREATING PRODUCTS
Our Go2PAY web portal will allow you to create a product & add the title, descriptions, pricing & other relevant information. Each product will be given a unique URL & QR code for placement on your web site or other online portal.
1.1.1 PROHIBITED PRODUCTS
You must not use Stripe’s services for the following activities.
1.2 PAYMENT FOR PRODUCT SALES & SERVICES
The Go2PAY portal will allow you to update your payment setting to receive payments for your product sales. In some cases we may contact you regarding identity verification. This may require you to submit identification documents about your Personal or Business registered accounts. The portal will display your order for reference & download if required. You will be able to manage your account & make withdrawals etc.
1.3 FEES
No setup, monthly or other recurring fees. Customers pay a processing fee on the checkout page of (2.9% + .5). We charge a vendor fee & may charge a wire fee to transfer funds to your vendor account depending on the type & location of the account you provided.
1.4 CHARGEBACKS FOR ONLINE CARD PAYMENTS
Any credit/debit card chargebacks initiated by a customer for any reason with respect to a your Go2PAY Product or service shall be charged back to you the Vendor/Member. Go2fete.com in its sole discretion shall deduct these costs from such Vendor/Member outstanding balance.
The purpose of a dispute is to recover funds for transactions that have already been captured. Disputes are often used to redress fraudulent transactions or problems with the quality or delivery of the products or service. This process typically takes between 30 and 90 days & a US$15 fee will apply to each disputed transaction. The required evidence must be submitted to us so we can provide the required documents to assist in settling the dispute, if the resolution is in our favor will be returned the disputed funds to your account with any fees deducted.
1.5 CONFIRMATION
Upon receipt of a Credit/Debit card authorization from each individual product purchaser, Go2fete.com generates a confirmation message and issues a unique confirmation receipt which is emailed to the buyer & the Vendor. You agree to unconditionally accept, honor, and fulfill all product commitments that have been confirmed by Go2fete.com through the Go2PAY Services, and it is your responsibility to verify the applicable customer membership status, confirmation number and/or any Product restrictions. If we learn that you are not honoring your Go2PAY products commitments, we reserve the right, in our sole discretion, to terminate your account without liability or further obligation.
1.6 TAXES; WITHHOLDING
You are responsible for (and will indemnify and hold harmless Go2fete.com against) all taxes or other governmental charges associated with Your Product through the Services (excepting taxes based on Go2fete.com's net income). For example, some states may charge an amusement or other tax on certain types of products. It is your responsibility to know if any applicable laws apply to you and to adjust your product price accordingly to account for your payment of these taxes.
If Go2fete.com determines that it is required to collect or pay any such taxes or other charges, it may deduct such amounts from any balance payable to you under this Agreement or else invoice You for such taxes or other charges. Go2fete.com reserves the right to withhold the payment of any amounts owed to You hereunder if Go2fete.com suspects or determines that such amounts have been generated in (i) a fraudulent manner, (ii) violation of this Agreement or the TOS, or (iii) violation of any applicable laws or regulations (foreign or domestic). Such withholding may be temporary or permanent (as determined by Go2fete.com).
1.7 REPRESENTATIONS AND WARRANTIES
You represent and warrant the following:
You are the owner, You have the authority and right to offer, sell, and honor the products sold on Our website; the product itself and any description or content provided by You to Us for use on Our website is/are not (and does not contain, promote, or link to material or content that is) pornographic, defamatory, grossly offensive, harassing, malicious, illegal, or otherwise objectionable, and do not infringe or violate (or contain, promote or link to material or content that infringes or violates) the rights of any person or entity, including, but not limited to, copyright, trademark, trade secret, proprietary, intellectual property, and rights of privacy and/or publicity, whether by statute or common law; and the Product and the sale does not constitute a violation of any federal, state, and/or local laws.
1.8 REFUNDS
It is your responsibility to communicate your refund policy to the buyers of your products.
Once confirmed by you Go2fete will issue refunds of the face values of the products as processing fees are nonrefundable. If no refund policy is provided by you to your customers Go2fete purchase terms will take effect.
1.9 ACCESS
You understand and agree that the Site may, at times, be inaccessible or inoperable for any reason, including, but not limited to: (i) equipment or communications malfunctions; (ii) periodic maintenance, repairs, or administrative reviews which We may undertake from time-to-time; or (iii) causes beyond Our reasonable control or which are not reasonably foreseeable by Us, such acts of government or the malicious or criminal acts of third parties. natural disasters or pandemics.
2.0 TERMINATION
Except as provided elsewhere in this Agreement, either party may terminate this Agreement at any time upon seven (7) calendar days’ written notice to the other.
